As you may already know, European workers (i.e., from the EU, EEA, and Switzerland) must apply to the EU Settlement Scheme to continue living and working in the UK after June 30th, 2021.
Summary:
- European workers must apply to the EU Settlement Scheme before 30/06/2021.
- Workers must apply on GOV.UK and obtain a Share Code ID.
- Agencies must upload this Share Code ID onto GOV.UK to obtain a RTW (Right to work) document.
- This document must then be uploaded onto ENGAGE worker profiles as proof.
- Workers without this RTW document will be marked as βNot OK to Payβ from 01/07/2021.
What must workers do?
For workers to prove that they can still work in the UK after the cut-off date, they must apply online and get either a settled or pre-settled status. You can read more about this at the following links and forward them to your contractors:
Registration is simple however as we are fast approaching the deadline, please double-check that all of your workers are aware of the changes and how they will be affected.
To prove that they are eligible for work, contractors must provide you with their Share Code ID. They can obtain this by following the steps on GOV.UK website using the same document they applied to the scheme with.
What must agencies do?
Once you have the code, you need to enter it onto GOV.UK website. A valid code will produce PDF file with:
- a photo of your worker
- details of their settlement status
- details of their employment
This document must then be uploaded on the ENGAGE portal as proof of right to work.
What's changing on ENGAGE?
We've developed a new feature that allows you to upload this document onto a worker's profile. As part of the implementation, every qualifying contractor (regardless of their start date) will receive a notification to resubmit their Right to Work document in order to provide you with the Share Code ID.
Effective from July 1st 2021 every worker with an EU, EEA or Swiss passport without this document uploaded onto their profile will be marked as 'Not OK to pay'. This feature is a legal requirement and cannot be turned off.
